Who this site is for
This site is for business owners and the professionals who advise them, in the United States. You must be at least 18 to use it. If you use it for a company, you confirm that you may accept these terms on its behalf.
Information, not advice
Everything on this site is for general information and education. It is not legal, tax, accounting, actuarial, underwriting, insurance, or investment advice, and it does not account for your circumstances. Captive insurance is complex and heavily regulated, and the rules change. Talk with your own legal, tax, accounting, and risk management professionals before you act on anything you read here.
Fortress does not provide legal, accounting, actuarial, underwriting, or investment services, and it is not an investment advisor. Credentialed actuaries analyze risks and set premiums. A licensed third‑party insurance manager administers each captive we consult on.
No attorney-client or other professional relationship
Some of the people at Fortress are attorneys or accountants, but they do not act in that role for you through this site. Reading the site, submitting a form, booking a call, or talking with us on a call does not make you a client of Fortress, and it does not create an attorney‑client, accountant‑client, advisory, or fiduciary relationship. You become a client only when you and Fortress sign an engagement letter, and that letter then governs the work.
Please do not send us confidential information through this site. What you send through a form may not be kept confidential or privileged.
No offer, and no promised result
Nothing on this site is an offer to sell insurance or securities, or a solicitation to buy them. Whether a captive suits a business, and how it is treated for tax purposes, depends on the facts and the law. We do not promise any tax result, premium, savings, or formation date. Past results and the examples on this site do not predict what will happen for you.
The fit check and your reading
The fit check is a quick educational tool. Its result, and any reading we send you afterward, is a starting point for a conversation. It is not an underwriting decision, an actuarial opinion, a recommendation to form a captive, or a promise that Fortress will take you on.
Booking a call
Booking a call reserves a time and nothing more. We may reschedule or cancel a call, and we may decline an engagement for any lawful reason. If you ask us to contact you, we may reply by email or phone about your request.
Advisors
Signing up for the founder's talk, or for anything else on the advisor pages, does not make you an agent, partner, employee, or representative of Fortress, and you may not say that it does. You remain responsible for your own licenses, your compliance obligations, and what you tell your clients. The Certified Captive Consultant™ course and any advisor tools may carry their own terms when they are released.

Fortress content and marks
Fortress or its licensors own the content on this site, including its text, graphics, logos, photographs, tools, and design. You may view it and print a copy for your own reference. You may not copy, sell, adapt, or republish it, or use it to promote your own business, without our written permission. The Fortress name and logo, Turning risk into wealth.℠, and Certified Captive Consultant™ are marks of Fortress, and you may not use them without our written permission.
Using the site properly
- Give accurate information, and submit only your own information or information you have the right to share.
- Do not interfere with the site, test its security, or try to reach areas you were not given access to.
- Do not scrape the site or collect its content with automated tools, except for ordinary search engine indexing.
- Do not use the site for anything unlawful, or to send anything harmful or misleading.
Other sites and services
This site links to other sites and relies on outside services, such as our scheduling tool. We do not control them and are not responsible for their content or how they work. Their own terms apply when you use them.
The site is provided as is
We work to keep the site accurate and available, but it may contain errors or go out of date, and it may be interrupted at any time. To the fullest extent the law allows, we provide it "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non‑infringement.
Limits on our liability
To the fullest extent the law allows, Fortress and its owners, officers, employees, and service providers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, tax costs, or penalties, that arise from your use of the site or your reliance on it. Our total liability for any claim about the site is limited to $100. These limits apply only to the site. A signed engagement letter governs liability for work under that letter.
Your responsibility
If your misuse of the site or your breach of these terms leads to a claim against Fortress by someone else, you agree to cover the resulting losses and reasonable costs, including attorney's fees.
Governing law
Colorado law governs these terms and any dispute about the site, without regard to its conflict‑of‑law rules. Any such dispute belongs exclusively in the state or federal courts located in El Paso County, Colorado, and you agree to their jurisdiction.
Changes and other terms
We may change the site or these terms at any time. When we change these terms, we will post the new version here with a new effective date, and using the site after that means you accept it. If a court finds part of these terms unenforceable, the rest still applies. If we do not enforce a term right away, we can still enforce it later. If you have a signed agreement with Fortress, that agreement controls wherever it conflicts with these terms.
